Do you need to apostille a marriage certificate? There are many reasons why another country will ask for an Apostille on your marriage certificate. Some of the examples are: If you are planning to obtain dual-citizenship, buy property, inheritance, divorce, or planning to retire in another country. Whatever your reason is, this article will provide you step by step marriage certificate Apostille NYC guide.

What is an Apostille?

An Apostille authenticates the origin of a public document for international use as per the 1961 Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents. An Apostille certifies official seals and signatures on legal documents, such as marriage certificates, to be recognized in foreign countries that are parties to the Hague Convention.

There are countless situations where an Apostille is needed, such as international relocations, applications for studies, or international business transactions and foreign investment procedures. A Hague Convention member country can issue an Apostille for use in another Hague Convention member country.

The 1961 Hague Apostille Convention

The 1961 Hague Convention abolishing the Requirement of Legalization for Foreign Public Documents established Apostille guidelines. The treaty set a standard process for getting an Apostille, such as the step-by-step marriage certificate Apostille NYC process and other legal documents. The Apostille from one member country is legally certified for use in all other member countries.

Before the 1961 Hague Apostille Convention, the authentication of public documents was a complicated process, requiring tons of forms as attachments to the paper for certification. The Hague Convention of 1961 or the Apostille Treaty provides for the much-simplified certification of public (including notarized) documents to be used in countries that have joined the convention. Under the Hague Convention, signatory countries have agreed to recognize Apostilled public records issued by other signatory countries.

Apostille in New York City

On October 15, 1981, the United States joined the 1961 Hague Convention abolishing the Requirement of Legalization for Foreign Public Documents. The United States attempted to streamline the step-by-step marriage certificate Apostille NYC process and all other public documents throughout the United States. The used to be a complicated process of authenticating your documents has become simpler.

New York City has one of the highest demands for Apostille in the United States. There is a steady and heavy demand for Apostille services in NYC, from corporate headquarters to diverse nationalities.

Step by Step Marriage Certificate Apostille NYC

Below are a three-step process for obtaining an NYC Apostille for your marriage certificate.

Step One: Obtaining a record of your marriage certificate.

The apostille procedure requires a certified copy of a marriage Certificate which you can obtain from the City’s Marriage Bureau. The marriage certificate should bear the wet signature of the City Clerk together with an embossed seal and Certification Stamp at the back.

Step Two: Authentication by the County Clerk.

The following step-by-step marriage certificate apostille NYC process is to have your marriage certificate authenticated by the County Clerk or a state official before getting it Apostilled. Your marriage certificate must have an original hand signature and the certification stamp of the County Clerk. Present your request for marriage certificate authentication to the County Clerk’s Notary Desk at 60 Centre Street, Room 141B.

You may also submit it to the County Clerk by mail and address it to the County Clerk of New York County, New York County Courthouse, 60 Centre Street, Room 161, New York, NY 10007. If your documents are in proper order, the County Clerk will authenticate them and return them to you by mail.

The submission by mail must be accompanied by a certified personal check or US postal order, payable to the County Clerk of New York County. Do note that the office only accepts this form of payment through the mail.

Furthermore, mail applications must include a stamped, self-addressed envelope for the return of the documents by the County Clerk. The County Clerk does not have the facilities to return documents by delivery service or postal mail. The applicant should plan and submit the proper postage to ensure a trouble-free return.

Due to the volume of matters received, the County Clerk of New York County generally requires up to four weeks to process applications for authentication submitted by mail. Meanwhile, documents presented in proper form in person are processed immediately.

Step Three: Issuance of Marriage Certificate Apostille

The third on the step-by-step marriage certificate Apostille NYC process is the issuance of the marriage certificate Apostille by the New York State Department of State. Once the County Clerk has authenticated your documents, you must submit your verified documents to the Secretary of State of the State of New York ( on the second floor) at 123 Williams Street in Manhattan. It is between Fulton and John Streets, a few blocks south of Foley Square, within walking distance, to obtain the Apostille. Their business days and hours are from Monday to Friday, 9 AM to 3:30 PM.

In this step, you will have to complete an apostille application form. The documents in question, properly authenticated, must be attached to it and a fee paid.

If you submit your documents by mail, you must ensure their prompt delivery by sending them to the correct mailing address. The accurate mailing address is: NYS Department of State, Division of Licensing Services, PO Box 22001

Albany, NY 12201-2001.

The step-by-step marriage certificate Apostille NYC process can be complicated. It would be best not to let untrained individuals or non-professionals who do not fully understand the Apostille process and specific countries’ unique requirements do this. Delays or even rejection of your papers can cost you time and money. Don’t let this happen to you.
