What is an Apostille?

An Apostille authenticates the origin of a public document for international use as per the 1961 Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents. An Apostille certifies official seals and signatures on public documents, such as birth certificates, to be recognized in foreign countries that are parties to the Hague Convention. A Hague Convention member country can issue an Apostille for use in another Hague Convention member country.

The Hague Convention of 1961 established a way for nations to authenticate public documents without legislation. All participating countries of the Hague Convention readily accept an Apostilled document. The Hague Apostille speeds up and simplifies the legalization and acceptance of international documents.

Public document authentication in the United States was a seemingly complicated process. It used to require tons of forms to support the notarized document. However, on October 15, 1981, the United States joined the 1961 Hague Convention Abolishing the Requirement of Legalization for Foreign Public Documents. The United States attempted to streamline the process: the Apostille birth certificate NYC service has become simpler.

There is a steady and tremendous demand for Apostille services in New York City. It will take quite a while for you to get your birth certificate Apostille done. However, if you go through the steps below correctly, getting your birth certificate Apostille in NYC should only take up to four days.

Apostille Birth Certificate NYC Service – Step by Step

Step 1: Obtain your birth certificate 

The first step, of course, is to obtain a copy of your birth certificate. The birth certificate should come with a letter of exemplification which you need to request from the New York City Department of Health and Mental Hygiene, Vital Records Division.

A letter of exemplification attests that the attached birth certificate is a true and certified copy. Do note that the issuance of a letter of exemplification is only upon request. You can file your request for the exemplification to the said department: either in person, by mail, or online.

Note: Birth certificates do not need to be and should not be notarized.

Step 2: Authentication by the County Clerk

Apostille Birth Certificate NYC Service – the second step in the process is the authentication of the birth certificate by the County Clerk. Again, the birth certificate must have a letter of exemplification on a separate page.

You may submit your documents to the County Clerk of New York County, by mail or in person. If you submit in person, the processing of your documents will be immediate. However, if you submit by mail, it will generally take three to four weeks to get your documents processed; due to the volume of documents received in the mail by the County Clerk’s office.

To make your Request for Authentication in person, you can present it to The County Clerk’s Notary Desk at 60 Centre Street, Room 141B.

When requesting by mail, if the documents are in proper order, the County Clerk will authenticate them and return them to the applicant by mail. Your mail submission must come with a certified personal check or U.S. postal order, made payable to the County Clerk of New York County. 

Mail applications must also include a stamped, self-addressed envelope for the return of the documents by the County Clerk. The County Clerk does not have the facilities to return documents by delivery service or postal express mail, so the applicant should plan accordingly and submit the proper postage to ensure a trouble-free return.

Step 3: To the New York Department of State – secure the Apostille Birth Certificate NYC Service

The third and final step in the process is the issuance of the birth certificate apostille or certificate of authentication by the New York State Department of State. You will complete an application form here, and the authenticated documents in question must be attached to it. There is a fee requirement here.

  1. Complete the Apostille/Certificate of Authentication Request Form. 
  2. You must attach your properly authenticated documents to the completed Apostille/Certificate of Authentication Request Form.

The Department of State will not accept payments in cash. So make sure you have a money order. There is also a per document fee.
